In allen drei Skandalen gab es vor dem Kollaps einen Fall von Whistleblowing, einem internen Notruf also, der auf Rechtsverletzungen aufmerksam machte. Allerdings kam die Meldung entweder zu spät oder wurde nicht ernst genommen, so dass der GAU in allen drei Fällen nicht mehr verhindert werden konnte.
Vorfälle wie diese sind herbe Rückschläge für die Wirtschaft und Gift für das Investitionsklima und die Konjunktur. Eine Reaktion seitens des Gesetzgebers in den USA blieb nicht aus: Zur Verschärfung der Corporate Governance und zur Schaffung einer fundierten rechtlichen Grundlage wurde Mitte 2002 der ‚Sarbanes Oxley Act’ (fortan SOX) mit dem Ziel der Rückgewinnung des Investorenvertrauens in Kraft gesetzt. Der SOX enthält nebst den Paragraphen zum Schutz auch Paragraphen zur Förderung von Whistleblowing. Die zugrunde liegende Argumentation geht davon aus, dass Whistleblowing im Sinne eines Frühwarnsystems Rechtsverletzungen in Unternehmen rechtzeitig erkennt, potentielle Gefahren identifiziert und das Übel im besten Fall im Keim erstickt. Die Verhinderung eines Skandals ist nicht nur im Interesse der Unternehmung selbst, sondern lässt die Gesellschaft und die Wirtschaft als Ganzes von der Erhaltung der Arbeitsplätze profitieren.
Je früher, genauer und einfacher eine Meldung erfolgen kann, umso deutlicher fallen die Vorteile für die involvierten Parteien aus. Um dies zu erreichen, muss ein Umfeld geschaffen werden, welches dem Whistleblowing freundlich gestimmt ist. Da der Nutzen des Whistleblowing für die Unternehmen oft nicht leicht ersichtlich ist und bestenfalls erst in Zukunft anfällt, die Massnahmen aber mit heutigen Mehrkosten verbunden sind, müssen Gesetze den notwendigen Druck schaffen.
