Depois surgiu a ideia que o próprio Estado tem o dever de zelar para que os direitos básicos dos indivíduos sejam respeitados. Através dos direitos fundamentais é estabelecido o limite imposto ao Poder Público, para que determinado âmbito particular de uma pessoa não possa ser penetrado por quem quer que seja.É preciso ressaltar, entretanto, que as matrizes dos direitos humanos foram construídas por uma classe dominante. Vale dizer: segundo a ética do homem (ser masculino) branco, cristão, ocidental e proprietário. Assim, é possível afirmar que os direitos humanos são direitos burgueses que acabam por justificar e perpetuar o modelo de Estado liberal burguês. Até mesmo os direitos sociais são direitos compensatórios, que pretendem manter a dominação da grande massa no modelo de Estado atual.De qualquer forma, em qualquer modelo de Estado, certas necessidades dos seres humanos devem ser respeitadas. É certo que a humanidade partilha de alguns valores comuns que devem ser garantidos. Mas, outros, variam de lugar para lugar e de tempos em tempos. Com efeito, a liberdade, a igualdade e a dignidade do homem são ideais a se perseguir em qualquer local ou em qualquer época. Outros mudam de culturas a culturas e de tempos em tempo. E mais, mesmo o que se entende por tais direitos pode mudar conforme o entendimento de cada um.
