Sie begründen dann zusätzlich zu einer öffentlich-rechtlichen Pflicht eine privatrechtliche Verpflichtung, die der Arbeitgeber gegenüber dem einzelnen Arbeitnehmer zu erfüllen hat.
Arbeitnehmer haben nach § 5 Abs. 1 ArbSchG in Verbindung mit § 618 Abs. 1 BGB Anspruch auf eine Beurteilung der mit ihrer Beschäftigung verbundenen Gefährdung. § 5 Abs. 1 ArbSchG räumt dem Arbeitgeber bei dieser Beurteilung einen Spielraum ein. Der Betriebsrat hat bei dessen Ausfüllung nach § 87 Abs. 1 Nr. 7 BetrVG mitzubestimmen. Der einzelne Arbeitnehmer kann deshalb nicht verlangen, dass die Gefährdungsbeurteilung nach bestimmten von ihm vorgegebenen Kriterien durchgeführt wird.
